User Terms

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "Vendor", or "User") and LeadGenix Company ("LeadGenix", "we", "us", or "our"), the legal owner and operator of the AIUplink platform and mobile applications.

By creating an account, accessing https://aiuplink.info, connecting your WhatsApp Business account, or downloading the AIUplink mobile application from Google Play Store or Apple App Store, you agree to comply with and be bound by these Terms.

2. Eligibility & Account Responsibilities

• You must be at least 18 years of age and possess the legal authority to represent your commercial entity.
• You are responsible for maintaining the confidentiality of your account credentials, tokens, and multi-agent logins. Any activity conducted under your account is your sole legal responsibility.
• You agree to immediately notify LeadGenix at info@leadgenix.in of any suspected unauthorized access or security breach.

3. Meta WhatsApp Policies & Anti-Spam Compliance

As a software connecting to the Meta WhatsApp Cloud API, all users must strictly adhere to:

• Meta WhatsApp Business Policy & WhatsApp Commerce Policy: Prohibiting the sale or promotion of illegal products, prescription drugs, weapons, alcohol, adult content, gambling, and misleading financial schemes.
• Customer Opt-In Mandate: You must have explicit consent/opt-in from recipients before initiating broadcast marketing messages or WhatsApp templates.
• Zero Tolerance for Spam: Sending unsolicited bulk spam, deceptive content, or harassing messages is strictly prohibited. LeadGenix reserves the right to immediately terminate or suspend accounts that receive high spam reports or block rates from Meta.

4. Subscriptions, Usage Fees & Meta Charges

• Platform Subscription: AIUplink SaaS plans are billed on a recurring basis (monthly, quarterly, or annually) as selected during registration.
• Meta Official Conversation Charges: WhatsApp conversation costs (marketing, utility, authentication, service) are determined by Meta Platforms Inc. Customers must maintain a valid payment method directly in their Meta Business Manager or maintain adequate conversation wallet balance. LeadGenix is not responsible for message delivery halts caused by unpaid Meta invoices or expired credit cards in Meta Business Manager.

5. Intellectual Property Rights

All software code, interfaces, graphics, logos, and features of AIUplink are the proprietary intellectual property of LeadGenix Company. WhatsApp and Meta are registered trademarks of Meta Platforms, Inc. AIUplink is an independent software solution utilizing Meta's authorized public APIs.

6. Limitation of Liability & Service Uptime

AIUplink is provided on an "AS IS" and "AS AVAILABLE" basis. While we maintain 99.9% platform availability, LeadGenix shall not be held liable for delivery delays or downtime resulting from Meta WhatsApp Cloud API network outages, mobile carrier filters, or customer violation of Meta policies.

7. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in New Delhi, India.
